1.Important Notice

These Terms and Conditions apply to all quotations, sales, and use of the Flo Glass website unless otherwise agreed in writing.

Information provided by Flo Glass, including product descriptions, guides, and tools, is general in nature and does not constitute building, engineering, compliance, or certification advice. Customers should obtain independent professional advice where required.

Nothing in these Terms excludes, restricts, or modifies any rights or remedies available under the Australian Consumer Law (ACL).

2.Fence Builder & Quoting Tools

The Flo Glass Fence Builder and any online tools are provided as planning and estimating aids only.

Outputs (including quantities, layouts, and pricing) are based solely on information entered by the user and do not account for site-specific factors such as soil conditions, wind exposure, structural adequacy, site levels, access constraints, or the proximity of climbable objects.

Flo Glass has not conducted a site inspection and does not verify user-entered data.

While reasonable care is taken to ensure accuracy, Flo Glass does not guarantee that outputs are complete or suitable for your specific project. Customers are responsible for verifying all measurements, specifications, and compliance requirements prior to purchase.

All quotations are valid for thirty (30) days unless otherwise stated and may change if scope or specifications vary.

3.Customer Responsibilities

The Customer (and/or their installer) is responsible for ensuring products are suitable for their intended use, obtaining all required approvals, permits, and certifications, ensuring installation complies with all applicable laws, codes, and standards, and obtaining independent engineering or compliance advice where required.

Flo Glass may provide general information or assistance in good faith; however, final responsibility for design, installation, and compliance remains with the Customer and/or their engaged professionals.

4.Product Information & Limitations

Glass panels: All panels are manufactured from toughened safety glass in accordance with AS/NZS 2208. Toughened glass may, in rare cases, experience spontaneous breakage due to inherent characteristics of the material.

Hardware: Hardware is manufactured from 316-grade stainless steel. Surface staining (tea staining) may occur in coastal environments and does not affect structural integrity. Regular maintenance is recommended.

Structural & installation considerations: The maximum post spacing is 3000mm centre-to-centre. Substrate suitability must be assessed by the installer or engineer, and certain substrates may require engineering certification.

General: Minor variations in finish or appearance may occur and do not constitute defects.

5.Pool Fencing & Compliance

Flo Glass systems have been engineered and are supported by a Form 15 (Design Certification) confirming compliance with relevant Australian Standards when used within specified parameters.

However, compliance depends on correct installation and site-specific conditions. Factors affecting compliance include ground levels, climbable objects, gate positioning and hardware, proximity to structures, and local council requirements.

Customers are strongly encouraged to engage a licensed certifier or inspector before installation.

6.Balustrade Applications

Flo Glass systems may be used as balustrades where installed in accordance with applicable standards and engineering requirements.

Customers are responsible for ensuring the structural adequacy of supporting structures, obtaining required approvals, and engaging appropriate professionals for certification.

7.Installer Directory

The Flo Glass installer directory is provided as a convenience only. Installers are independent contractors and are not employees, agents, or endorsees of Flo Glass.

Any agreement between a Customer and an installer is solely between those parties. Flo Glass is not responsible for installation outcomes.

8.Payment & Ownership

Full payment is required prior to dispatch unless otherwise agreed. A minimum 50% deposit may be required to secure stock. All goods remain the property of Flo Glass until paid in full, and risk passes to the Customer upon collection or delivery.

Prices include GST unless otherwise stated.

9.Delivery & Collection

Collection: Customers must ensure suitable transport and handling equipment. Flo Glass is not responsible for damage or injury during loading or transport.

Delivery: Customers must be present to receive deliveries and assist with unloading where required.

Freight: Third-party freight is subject to carrier terms. Delivery timeframes are estimates only. Risk transfers to the Customer upon dispatch or delivery, as applicable.

10.Defective Goods & Claims

Customers are encouraged to inspect goods upon delivery or collection and notify Flo Glass promptly of any issues.

Where a product is found to be defective, Flo Glass will provide a remedy in accordance with the Australian Consumer Law, which may include repair, replacement, or refund depending on the nature of the issue. Nothing in this section limits the Customer's rights under the Australian Consumer Law.

11.Returns & Refunds

Returns may be accepted within 30 days for unused and undamaged standard products. Custom or made-to-order products and installed or modified goods are excluded from this policy.

Return freight is the responsibility of the Customer unless required under the Australian Consumer Law. This policy does not affect rights under the Australian Consumer Law.

12.Warranty & Consumer Guarantees

Flo Glass products are covered by a manufacturer's warranty against defects in materials and workmanship, subject to proper installation and use.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, compensation for reasonably foreseeable loss or damage, and repair or replacement if goods fail to be of acceptable quality.

13.Limitation of Liability

To the extent permitted by law, Flo Glass's liability for any claim relating to goods or services is limited to repair, replacement, or refund.

Flo Glass is not liable for indirect or consequential loss (such as loss of profit or delay) where permitted by law. Nothing in these Terms limits or excludes any rights under the Australian Consumer Law that cannot be excluded.

14.Website Use

Website content is provided for general information purposes only. While reasonable care is taken, Flo Glass does not guarantee that information is complete, current, or error-free. Flo Glass may update or change website content at any time without notice.

15.Force Majeure

Neither party is liable for delays or failure to perform obligations due to events beyond reasonable control, including natural disasters, supply disruptions, or industrial action.

16.Governing Law

These Terms are governed by the laws of Queensland, Australia.

17.Acceptance of Terms

By using the website or placing an order, you agree to these Terms. Flo Glass may update these Terms from time to time. Continued use of the website constitutes acceptance of any updates.
